These Terms of Use ("Terms") are an agreement between you and Black Rainbow ("we", "our", or "us") for the Grumpy Frenchie mobile application (the "App"). By creating an account or using the App, you agree to these Terms and to our Privacy Policy.
If you do not agree, do not use the App.
Grumpy Frenchie is a voice AI companion. It can talk with you, animate a character on your phone, and (if you enable them) use optional device tools such as calendar, messages, weather, home controls, music, and health summaries.
An account is required. The App is intended for users 16 years of age or older.
You must provide accurate information and keep your login details secure. You are responsible for activity on your account. We may suspend or close an account that we reasonably believe is abusing the service, violating these Terms, or creating legal risk.
To delete your account and associated cloud data, use Settings → Account → Delete Account in the App. Uninstalling the App removes local data but does not close the cloud account. If in-app deletion fails, email jean@weareblackrainbow.com from the address on the account. Deleting your account does not cancel a paid subscription; manage that in your Apple or Google account settings.
The App offers a free tier with a limited number of voice minutes and a paid Pro subscription with higher limits and extra features (including wake word, follow-up listening, extra voices, memory, live translation, web search, and optional device tools). Current prices, minute limits, and included features are shown in the App at the time of purchase.
Pro is an auto-renewing subscription. Payment is charged to your Apple or Google account. The subscription renews unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage or cancel in your Apple ID or Google Play account settings. Unused minutes do not roll over as cash, and we do not offer refunds except where required by Apple, Google, or applicable law.
If you bought the subscription through the App Store, Apple's Standard Licensed Application End User License Agreement also applies: Apple Standard EULA.
The assistant is entertainment and general-purpose help. It can be sarcastic, rude, or (if you choose Uncensored) explicit. It can be wrong. Do not rely on it as professional advice of any kind, including medical, legal, or financial advice.
You agree not to use the App to:
You are responsible for what you ask the assistant to send or save (drafts, calendar events, memories). Draft emails and texts are not sent until you send them in the system composer.
Optional tools stay off until you enable them and grant permission. Health information is read only to answer your question in that session. The App is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease. Home and lock/security actions can affect the real world; confirm those requests yourself.
The App, character, and related content are owned by Black Rainbow or its licensors. You may not copy, reverse engineer, or redistribute the App except as allowed by law. Voice and text you provide remain yours; you grant us a limited license to process them so we can operate the App, as described in the Privacy Policy.
The App is provided "as is." To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We are not liable for indirect, incidental, special, or consequential damages, or for lost data, including from AI mistakes, missed reminders, or device-tool actions. Our total liability for any claim relating to the App is limited to the amount you paid us for the App in the 12 months before the claim (or, if you only used the free tier, fifty US dollars).
Some places do not allow these limits. In those places, our liability is limited to the greatest extent allowed.
We may update the App and these Terms. We will post the new Terms at https://grumpyfrenchie.com/terms/ with a new date. Continued use after a change means you accept the updated Terms.
